Legal Notice, Safety Disclaimer & Limitation of Liability

Belladonna Systems products are designed to provide an added layer of security for compatible window well covers, window well grates, and basement egress systems. No lock, latch, grate, cover, or security device can guarantee prevention of forced entry, unauthorized access, tampering, property damage, injury, or criminal activity.

Belladonna Systems products are not a substitute for proper home security, code-compliant egress windows, working smoke alarms, carbon monoxide alarms, emergency planning, supervision of children, or compliance with applicable building and fire codes. Customers are solely responsible for confirming product compatibility, proper installation, local code compliance, and routine inspection and maintenance.

Emergency egress openings must remain operable from the inside without keys, tools, special knowledge, or unreasonable delay. Belladonna Systems products must never be installed, modified, blocked, overtightened, or used in any manner that prevents emergency escape from inside the window well or basement area.

Belladonna Systems does not represent or warrant that its products will prevent break-ins, forced entry, theft, injury, death, property damage, or misuse by third parties. The effectiveness of any locking system depends on proper installation, compatible materials, condition of the window well or cover, environmental exposure, maintenance, and the force or tools used by another person.

By purchasing, installing, or using Belladonna Systems products, the customer agrees that Belladonna Systems shall not be liable for losses, damages, injuries, claims, or expenses arising from improper installation, product modification, incompatible use, failure to inspect or maintain the product, failure to follow instructions, code violations, misuse, neglect, unauthorized tampering, criminal acts, forced entry, or circumstances beyond the reasonable control of Belladonna Systems.

To the maximum extent permitted by law, Belladonna Systems’ liability for any claim related to the purchase or use of its products shall be limited to the purchase price paid for the product. Belladonna Systems shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to personal injury, death, property loss, burglary, security failure, lost profits, or loss of use.

Customers should inspect all locks, fasteners, release mechanisms, window well covers, and grates regularly and immediately discontinue use if any product appears damaged, corroded, loose, obstructed, improperly aligned, or difficult to operate. If a product does not release smoothly from the inside, it should not be used until corrected or replaced.

Installation and use of Belladonna Systems products constitutes acceptance of this Legal Notice, Safety Disclaimer, and Limitation of Liability.
